Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Proftoon website at proftoon.com, the master workspace at app.proftoon.com, student applications, APIs, integrations, and related services collectively referred to as the "Service".
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. About Proftoon
Proftoon is a platform that allows users to create, manage, publish, sell, and deliver educational courses and related digital content.
The Service may include tools for course creation, student enrollment, communication, scheduling, payments, artificial intelligence, media generation, analytics, integrations, and other related functionality.
2. Eligibility
You must be legally capable of entering into a binding agreement under the laws applicable to you.
If you use the Service on behalf of a company, school, organization, or other legal entity, you represent that you have authority to accept these Terms on its behalf.
Minors may use student-facing parts of the Service only with the authorization and supervision required by applicable law, including authorization from a parent, guardian, teacher, school, or other responsible adult where necessary.
3. Accounts
Some features require you to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for:
- Maintaining the confidentiality of your account credentials;
- All activity performed through your account;
- Using appropriate security measures to protect access to your account;
- Notifying us promptly if you suspect unauthorized access or misuse.
You may not share your account in a way that bypasses plan limits, access rules, payment requirements, or security controls.
4. User roles and responsibilities
The Service may distinguish between different user roles, including masters, course creators, teachers, administrators, and students.
Masters, course creators, teachers, and administrators are responsible for:
- The courses, materials, messages, and other content they publish;
- The accuracy and legality of information provided to students;
- Obtaining all permissions, licenses, and consents required for their content;
- Managing student access and participation;
- Complying with consumer, education, privacy, advertising, and tax laws;
- Obtaining parental or guardian consent where required for minors;
- Handling commitments made directly to students or customers.
Students are responsible for using the Service lawfully, respecting the rights of course creators and other users, and complying with the rules of the courses in which they participate.
5. Acceptable use
You agree not to use the Service to:
- Violate any applicable law, regulation, court order, or third-party right;
- Upload, publish, or distribute unlawful, fraudulent, or misleading content;
- Infringe copyright, trademark, privacy, publicity, or other rights;
- Harass, threaten, exploit, or harm another person;
- Distribute malware, malicious code, or content intended to disrupt systems;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Interfere with the security, integrity, availability, or performance of the Service;
- Scrape, copy, or extract data through unauthorized automated means;
- Circumvent usage limits, billing controls, access restrictions, or technical safeguards;
- Use the Service to send spam or unsolicited communications;
- Impersonate another person or misrepresent your identity or affiliation;
- Use the Service for activities that create an unreasonable risk to Proftoon or others.
We may investigate suspected violations and restrict or suspend access where reasonably necessary to protect the Service, users, or third parties.
6. User content
"User Content" means any course, text, image, document, audio, video, prompt, message, submission, file, or other material uploaded, created, generated, or shared through the Service.
You retain ownership of your User Content, subject to the rights granted in these Terms.
By submitting User Content to the Service, you grant Proftoon a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, adapt, and otherwise use that content only as necessary to:
- Provide and operate the Service;
- Deliver content to users you authorize;
- Process AI and media generation requests initiated by you;
- Maintain security, backups, and technical functionality;
- Comply with legal obligations and enforce these Terms.
You represent that you own or have all necessary rights to submit and use your User Content and that its use through Proftoon does not violate applicable law or third-party rights.
7. Artificial intelligence and generated content
The Service may include features that use artificial intelligence or third-party AI providers to generate or transform text, images, audio, video, and other content.
AI-generated output may be inaccurate, incomplete, offensive, unsuitable, or similar to content generated for other users. You are responsible for reviewing and verifying generated output before using, publishing, selling, or relying on it.
You must not use AI features to create or distribute content that violates law, these Terms, or third-party rights.
Proftoon does not guarantee that AI-generated content is unique, error-free, factually correct, legally compliant, or appropriate for a particular purpose.
8. Third-party services and integrations
The Service may integrate with third-party services such as Google Calendar, Firebase, PayPal, email providers, hosting providers, analytics services, and AI model providers.
Your use of third-party services may be governed by additional terms and privacy policies imposed by those providers.
Proftoon is not responsible for the availability, accuracy, security, content, or practices of third-party services.
You may disconnect optional integrations at any time through the available account settings or through the relevant third-party provider.
9. Google Calendar integration
If you connect Google Calendar, you authorize Proftoon to access and process the Google Calendar data covered by the permissions you grant through Google OAuth.
The integration may be used to:
- Display calendars available for connection;
- Check free and busy periods;
- Determine available booking times;
- Create, update, or delete calendar events;
- Synchronize lessons, meetings, and bookings with Google Calendar.
You are responsible for confirming that event details are accurate and that you have authority to create or modify events involving other people.
Proftoon is not responsible for missed appointments, duplicate events, incorrect availability, synchronization delays, notification failures, or changes made directly in Google Calendar or another connected service.
The processing of Google user data is further described in our Privacy Policy.
10. Subscriptions, credits, and payments
Some features may require a paid subscription, prepaid credits, a one-time payment, or another billing arrangement.
Prices, plan limits, included features, billing periods, taxes, and renewal terms will be presented before purchase or displayed in the relevant account or payment interface.
By purchasing a paid plan or service, you authorize the applicable payment provider to charge the payment method you select.
Unless otherwise stated:
- Subscriptions may renew automatically at the end of each billing period;
- You may cancel renewal before the next billing date;
- Cancellation stops future renewal but does not automatically refund the current period;
- Unused credits may expire according to the conditions shown at purchase;
- Plan limits and available features may differ between subscriptions;
- Taxes and payment processing fees may apply where required.

11. Course sales and transactions between users
Proftoon may allow course creators to offer paid courses, lessons, subscriptions, or related services to students.
Unless Proftoon expressly states otherwise, the course creator is responsible for:
- The description, price, quality, and delivery of the course;
- Providing any promised lessons, materials, support, or certificates;
- Complying with consumer protection and refund obligations;
- Issuing invoices or tax documentation where required;
- Resolving disputes relating to the course or services they provide.
Proftoon may provide technical payment or access tools but is not necessarily the seller or provider of each course offered through the Service.
12. Intellectual property
The Service, including its software, interface, design, branding, logos, documentation, and underlying technology, is owned by or licensed to Proftoon and is protected by intellectual property laws.
These Terms do not transfer ownership of the Service or Proftoon intellectual property to you.
Subject to these Terms, Proftoon grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purposes.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except where permitted by applicable law or expressly authorized by Proftoon.
13. Feedback
If you provide ideas, suggestions, or feedback about the Service, you grant Proftoon the right to use that feedback without restriction or compensation, provided that we do not publicly identify you as the source without permission.
14. Availability and changes to the Service
We may add, change, suspend, limit, or discontinue features of the Service at any time.
We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device, browser, third-party service, or configuration.
Maintenance, updates, technical failures, provider outages, security incidents, or circumstances outside our control may temporarily affect availability.
15. Suspension and termination
You may stop using the Service at any time. You may request account deletion by contacting funMagister@gmail.com.
We may suspend, restrict, or terminate access if:
- You materially or repeatedly violate these Terms;
- Your use creates a security, legal, financial, or operational risk;
- Payment is overdue, reversed, disputed, or fraudulent;
- We are required to do so by law or a competent authority;
- The Service or relevant feature is discontinued.
Where reasonably possible, we may provide notice before termination. Immediate action may be taken where necessary to prevent harm, fraud, abuse, or security incidents.
Provisions that by their nature should survive termination will remain in effect, including provisions concerning ownership, payment obligations, disclaimers, liability, and dispute resolution.
16. Disclaimers
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.
Proftoon does not make warranties that:
- The Service will meet every user's requirements;
- The Service will be uninterrupted, secure, or error-free;
- Generated content or analytics will be accurate or complete;
- Courses offered by users will achieve a particular educational or commercial result;
- Third-party integrations will always remain available or compatible;
- Data loss, synchronization errors, or delivery failures will never occur.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded under applicable consumer law.
17. Limitation of liability
To the maximum extent permitted by applicable law, Proftoon will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, data, or content.
To the maximum extent permitted by law, Proftoon's total aggregate liability arising from or relating to the Service will not exceed the greater of:
- The amount you paid directly to Proftoon during the three months before the event giving rise to the claim; or
- Fifty euros (€50).
These limitations do not apply where liability cannot be limited or excluded under applicable law, including liability for fraud, intentional misconduct, or certain consumer rights.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold Proftoon harmless from claims, losses, liabilities, damages, and reasonable costs arising from:
- Your User Content;
- Your violation of these Terms;
- Your violation of applicable law or third-party rights;
- Courses, services, or commitments you provide to students or customers;
- Your misuse of the Service.
This section does not apply to the extent prohibited by applicable consumer law.
19. Privacy
Our collection and use of personal information are described in our Privacy Policy.
By using the Service, you acknowledge that personal information may be processed as described in that policy.
20. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, legal requirements, pricing, third-party integrations, or business practices.
We will publish the updated Terms on this page and update the "Last updated" date.
Where appropriate, material changes may also be communicated through the Service or by email.
Continued use of the Service after updated Terms take effect means that you accept the revised Terms, except where applicable law requires another form of consent.
21. Governing law and disputes
These Terms are governed by the laws of Spain, without prejudice to mandatory consumer protection rules that may apply in the country where a consumer resides.
Before starting formal proceedings, you agree to contact us and attempt to resolve the dispute informally.
Where permitted by applicable law, disputes relating to these Terms or the Service will be submitted to the competent courts in Spain.
Consumers may also have the right to bring proceedings before the courts of their place of residence where required by applicable law.
22. General provisions
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
A failure to enforce a provision is not a waiver of the right to enforce it later.
You may not assign your rights or obligations under these Terms without our prior written consent. Proftoon may assign these Terms as part of a merger, reorganization, sale of assets, or transfer of the Service.
These Terms, together with the Privacy Policy, Refund Policy, and any additional terms presented for specific features, form the agreement between you and Proftoon regarding the Service.
