Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Proftoon platform, including the website at proftoon.com, the master workspace at m.proftoon.com, related APIs, and any associated services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Who we are
Proftoon is operated by Aliaksei Utko ("we", "us", "our"). For questions about these Terms, contact us at funMagister@gmail.com.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service as a course creator ("Master"). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Students may access courses through invitations or enrollment links provided by a Master. Masters are responsible for ensuring that student participation complies with applicable laws, including parental consent where required.
3. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at funMagister@gmail.com if you suspect unauthorized access.
4. Description of the Service
Proftoon provides tools for:
- Creating and publishing online courses, including lessons, tasks, landing pages, and tariffs;
- Using AI-assisted features such as text generation, image generation, speech synthesis, and video production;
- Managing the learning process, student progress, messaging, and one-on-one sessions;
- Accepting and tracking payments between Masters and students where enabled;
- Connecting third-party services such as PayPal and Google Calendar.
We may modify, suspend, or discontinue any part of the Service at any time. Features labeled as beta, preview, or experimental may change or be removed without notice.
5. Master subscriptions and credits
Access to certain master features requires a subscription plan. Paid plans are billed on a recurring monthly basis through PayPal unless otherwise stated at checkout. Each plan includes a monthly allocation of platform credits ("tokens") used for AI and media operations.
- Unused credits may expire at the end of the billing period unless we state otherwise;
- Promotional codes, when offered, apply only as described at the time of redemption;
- We may change plan names, prices, credit amounts, or included features with reasonable notice where required by law.
Refunds for subscription charges are handled under our Refund Policy.
6. Payments between Masters and students
Masters may set course prices and receive payments from students through payment methods configured in the Service. We are not a party to those transactions. Masters are solely responsible for:
- Setting accurate prices and course descriptions;
- Delivering the educational content promised to students;
- Complying with tax, consumer protection, and licensing laws applicable to their courses;
- Handling student refund requests for course purchases according to their own policies and applicable law.
7. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, fraudulent, or misleading purposes;
- Upload or generate content that infringes intellectual property or privacy rights;
- Harass, abuse, or endanger other users, including minors;
- Attempt to reverse engineer, scrape, overload, or interfere with the Service;
- Share account access or resell platform credits except as expressly permitted;
- Use AI features to generate illegal content or content that violates our content standards.
We may remove content, suspend accounts, or terminate access if we reasonably believe these rules have been violated.
8. Your content
You retain ownership of content you upload or create through the Service ("User Content"), including course materials, images, videos, and messages. You grant us a worldwide, non-exclusive license to host, store, reproduce, display, and process User Content solely to operate, improve, and secure the Service.
You represent that you have all rights necessary to submit User Content and that it does not violate third-party rights or applicable law.
9. AI-generated output
AI features may produce inaccurate, incomplete, or inappropriate results. You are responsible for reviewing and approving all AI-generated content before publishing or sharing it with students. We do not guarantee the accuracy, originality, or suitability of AI output for any particular purpose.
10. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or proprietary materials except as needed to use the Service as intended.
11. Third-party services
The Service integrates with third-party providers such as PayPal, Google, Firebase, and AI model providers. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your account if you breach these Terms, create legal or security risk, or if we discontinue the Service. Upon termination, your right to access the Service ends, but sections that by nature should survive will remain in effect.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
16. Governing law
These Terms are governed by the laws applicable in the operator's place of business, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service should first be addressed by contacting us at funMagister@gmail.com.
